These terms govern your use of FBAR Reference. By using the site you agree to them. If you do not agree, please do not use the site.

1. Who these terms are with

2. The nature of this site

This site publishes general educational information about United States foreign financial account reporting, principally the FBAR (FinCEN Form 114).

• It is not tax, legal, accounting or financial advice, and must not be relied on as such.
• Using the site, or contacting us, creates no professional, advisory, fiduciary, attorney–client or accountant–client relationship.
• We are not a tax practice, law firm, filing service or referral service, and we do not prepare, review or submit any government form.
• We are not affiliated with, endorsed by or authorised by the Financial Crimes Enforcement Network, the Internal Revenue Service, the U.S. Department of the Treasury or any other government agency.

3. No reliance and no guarantee of accuracy

We take care to research the site against primary sources and to date each page, as described in our Editorial Policy. Even so:

• Content is provided “as is” and may be incomplete, simplified, or out of date.
• FBAR rules change. Penalty amounts are adjusted annually, deadlines are modified by notice, and the treatment of some assets is still developing.
• Nothing on the site accounts for your particular circumstances, which may change the answer entirely.
• You are responsible for verifying anything you intend to rely on against the official sources, and for obtaining professional advice where appropriate.

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.

4. Permitted use

You may read, print and share pages of this site for your own personal, non-commercial reference, and you may link to any page.

You must not:

• copy, republish or redistribute substantial parts of the site, or systematically reproduce its content, without our written permission;
• present our content as your own, or remove attribution;
• frame the site, or present it in a way that suggests an association, endorsement or partnership that does not exist;
• use the site or its content to train, fine-tune or evaluate a machine-learning model, or scrape it at scale, without our written permission;
• use automated tools in a way that imposes an unreasonable load on the site, or attempt to circumvent any technical measure;

5. Intellectual property

The text, design, layout, structure, stylesheets, code and compilation of this site are owned by St Fin Corp or licensed to us, and are protected by copyright and other laws. The site’s name and branding are ours.

Statutes, regulations, court opinions and government forms quoted or described on the site are works of the United States government or public records; our commentary on them is not. Short quotations of our content with clear attribution and a link to the page are permitted; wholesale reproduction is not. For permission requests, contact us.

6. Third-party links and content

The site links to government and other third-party websites, provided for reference. We do not control them, do not endorse their content, and are not responsible for their accuracy, availability, security or privacy practices. Following an external link is at your own risk, and the destination site’s own terms and privacy policy apply.

7. Advertising

The site carries advertising, which funds it. Advertisements are labelled and confined to defined slots. We do not select individual advertisements, do not endorse advertised products or services, and are not a party to any transaction between you and an advertiser. Any dealing with an advertiser is entirely at your own risk and on that advertiser’s terms.

8. Your messages to us

If you send us a correction, suggestion or other message, you grant us a non-exclusive, royalty-free, worldwide licence to use it for the purpose of operating and improving the site, including making a correction it identifies. We will not publish your name or contact details without your agreement.

Do not send us confidential information, account numbers, taxpayer identification numbers, balances, copies of returns or other sensitive documents. We do not want them, will not act on them, and will delete them.

9. Limitation of liability

To the maximum extent permitted by applicable law:

• We are not liable for any indirect, incidental, special, consequential, exemplary or punitive loss, or for any loss of profits, revenue, data, goodwill or opportunity, arising out of or in connection with your use of, or inability to use, the site.
• We are not liable for any penalty, interest, tax, professional fee or other cost incurred as a result of relying on the site rather than on the official sources or professional advice.
• Our total aggregate liability arising out of or in connection with the site, whether in contract, tort (including negligence), statute or otherwise, is limited to one hundred United States dollars (US$100).

Nothing in these terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for fraud or fraudulent misrepresentation. Some jurisdictions do not allow certain exclusions or limitations, in which case the exclusions and limitations above apply to the fullest extent permitted there.

10. Indemnity

You agree to indemnify and hold harmless St Fin Corp and its officers, employees and agents against any claim, loss, liability or expense (including reasonable legal fees) arising from your breach of these terms or your unlawful or improper use of the site.

11. Availability and changes to the site

We do not guarantee that the site will be available without interruption or free of errors. We may change, suspend, restrict or discontinue the site or any part of it, and may add, amend, move or remove content, at any time and without notice.

12. Changes to these terms

We may revise these terms from time to time. The review date at the top of the page shows the current version, and the revised terms take effect when published. Your continued use of the site after that indicates acceptance. If you do not accept the revised terms, stop using the site.

13. Governing law and jurisdiction

These terms and any dispute arising out of or in connection with them or the site are governed by the laws of the State of California and the federal laws of the United States, without regard to conflict-of-laws principles. You and we submit to the exclusive jurisdiction of the state and federal courts located in Orange County, California, except that either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property or the security of its systems.

If you are a consumer resident in a jurisdiction whose law gives you the benefit of mandatory local consumer protections or the right to bring proceedings locally, nothing in this clause deprives you of those rights.

14. General

• Entire agreement. These terms, together with our Disclaimer, Privacy Policy and Cookie Policy, constitute the whole agreement between you and us regarding the site.
• Severability. If any provision is held unenforceable, the remainder continues in force and the unenforceable provision is modified to the minimum extent necessary.
• No waiver. A failure to enforce a provision is not a waiver of it.
• Assignment. You may not assign your rights under these terms. We may assign ours in connection with a reorganisation or transfer of the business.
• No third-party rights. These terms confer no rights on anyone other than you and us.
• Headings are for convenience and do not affect interpretation.
