3. Not a government site

FBAR Reference is an independent, privately published website operated by St Fin Corp, a commercial company. It is not operated by, affiliated with, endorsed by, sponsored by or authorised by:

  • the Financial Crimes Enforcement Network (FinCEN);
  • the Internal Revenue Service (IRS);
  • the U.S. Department of the Treasury or the Bureau of the Fiscal Service; or
  • any other federal, state or foreign government agency.

References to those bodies, their forms, their publications and their websites are for identification and reference only and imply no association. Official government websites use the .gov domain; ours does not, and never will.

4. Not a filing or preparation service

We do not prepare, review, sign, submit or transmit any government form, and we never ask for your financial account details. The FBAR is filed free of charge through FinCEN’s own BSA E-Filing System — see how to file and official sources. Any website suggesting that a payment to it is required in order to file with the government should be treated with considerable caution.

5. Accuracy, completeness and currency

We research this site against the statute, the regulations, the current form instructions and official agency guidance, and we date each page — see our Editorial Policy. Nevertheless:

  • content is summarised and simplified, and omits exceptions, conditions and nuances;
  • rules change — penalty amounts are adjusted annually for inflation, deadlines are altered by notice, and the treatment of newer asset types such as virtual currency is still developing;
  • content may become out of date between reviews;
  • errors are possible despite our care; and
  • agency practice may differ from the strict text of a rule, and may itself change.

The site is provided “as is” and “as available”, without warranty of any kind, express or implied, to the fullest extent permitted by law.

6. Your circumstances are individual

FBAR outcomes turn on facts a website cannot know: your citizenship and residence history, the precise legal structure of each account and arrangement, whose money is in them, what you told a preparer, how any prior filings were made, and what you knew and when. Areas where the answer very often depends on such specifics include:

  • foreign pensions and employer retirement arrangements;
  • trusts, estates and beneficial interests;
  • the year in which residency begins or ends;
  • whether a signature-authority exception applies to you;
  • whether past conduct might be characterised as willful; and
  • which correction procedure fits missed or incorrect filings.

If any of these apply to you, take advice. The cost of an hour of professional time is small against the exposure described on our penalties page.

7. Examples and tools

Worked examples on this site use invented facts and are illustrative only; any resemblance to your situation is coincidental and does not make the conclusion applicable to you. Exchange rates used in examples are illustrative, not published figures.

The threshold self-check tool on our threshold page performs addition and nothing more. It runs entirely in your browser, stores and transmits nothing, does not apply any of the exceptions described on this site, and is not a determination of your filing obligation.

8. Third-party content and links

We link to government and other third-party websites for reference. We do not control them and are not responsible for their content, accuracy, availability, security or privacy practices. A link is not an endorsement.

9. Advertising

This site is free to read and funded by advertising. Advertisements are labelled and kept in defined slots. We do not select individual advertisements, do not endorse what is advertised, and are not a party to any transaction between you and an advertiser.
